Insurance Company To Pay Compensation Worth Kd 20,000 To A Kuwaiti

The Civil Court has ordered Ministry of Public Works and an insurance company to pay compensation worth KD 20,000 to a Kuwaiti citizen for the damages that his car sustained during the heavy rains witnessed in the country last year.

Representing the citizen was Lawyer Jarrah Al-Enezi who based his argument on the Court of Cassation’s mandate concerning compensation for the physical damages incurred during the heavy rains witnessed in the country last winter, stressing that his client’s car and its contents had sustained damages.

Meanwhile, the Court of Appeals dismissed a case filed against a Kuwaiti citizen due to statute of limitation, after the citizen was sentenced in absentia in 1999 to two-year imprisonment with hard labor for assaulting and humiliating a civil servant while on duty.

The Public Prosecution had charged the citizen of assaulting a civil servant and causing injuries as described in a forensic medical report. He was also charged with pushing and humiliating a traffic officer who was performing his duties, and threatening the civil servant with death in a bid to force her to drop the charges which she had filed against him.

Representing the citizen was Lawyer Ali Al-Wawan who said the statute of limitation in this case had elapsed, which warrants the case to be dismissed as per Article 4 of the Penal Code as well as other articles that support the cancellation of the verdict issued against his client.
