18 February 2024 Kuwait

Minister of Commerce and Industry Abdullah Al-Joaan issued Ministerial Resolution number 32/2024, in which he specified seven conditions that must be met before banning the import, display or sale of goods; provided all or some of the conditions are excluded from cases requiring the immediate ban of goods, reports Al-Anba daily. The resolution authorizes the Undersecretary to carry out duties legally prescribed by the Minister about prohibiting the import, display, and sale of goods and dangerous materials in the interest of the public or as per personal safety requirements.

It states that a decision to ban the import, display or sale of goods is issued only if the following conditions are met: presented to the minister before signing and issuing; based on a decision and an official letter from the concerned authority; based on objectives stipulated in the relevant law; an accurate description of the commodity to be banned in terms of trade name and international code; the rationale behind the ban; a statement on whether the ban includes the import, display or sale altogether or any of them only; and an appropriate grace period before the ban takes effect according to the nature of the commodity that will be banned.
