18 September 2017 Kuwait

Several Kuwaiti doctors are in the process of filing a lawsuit against the Ministry of Health, which is the first of its kind. The lawsuit centers on the different criteria of employment, such as refusing to appoint them while employing expatriate doctors in the same specialization.

Sometimes it so happens that both doctors (the expatriate and the Kuwaiti) have qualified from the same university where the expatriate gets the job and the Kuwaiti doesn’t. The source pointed this lawsuit will bring about what he called the ‘tsunami of lawsuits’.

The source indicated the Kuwaiti doctor is required to be a graduate from international universities and this is a prerequisite for his employment.

The source added Kuwaiti graduates from Arab universities, such as Jordan and Egypt are not appointed while expatriate doctors who have graduated from the universities of their countries get the job.

The source pointed out Article 26 of the Constitution provides that public services are a national service entrusted to those who hold them. Foreigners are not granted public office except in the cases prescribed by law.
