Lewd Acts Committed By Kuwaiti National, Syrian Expat

Kuwaiti media reported that two men - a Kuwaiti and a Syrian expat - were arrested after having sex inside a parked car in a remote area in Kuwait.

After an investigation, the Syrian told police officers he had been promised by the Kuwaiti that if he agreed to have sex with him, he would help him obtain a driving license.

The public prosecutor will take further legal actions against both of them after they are detained.

Penalties

Consensual sexual activity between men age 21 and older is criminalized by Article 193 of the Kuwaiti Penal Code with a term of imprisonment of up to seven years. Relationships between men under 21 are also covered by Article 192.

In public places, making a "lewd signal" is prohibited by Article 198. In 2008, it was also made illegal to imitate the appearance of someone of an opposite sex with fines and/or imprisonment.

Kuwait's Constitutional Court overturned this provision in February 2022, arguing that it violated citizens' rights, and that the law was too vague.
