Court Rejects Gulf National's Lawsuit Over Phone Misuse And Defamation

In a lawsuit filed by a girl of Gulf nationality against a Kuwaiti woman on charges of misusing the phone, insulting her, and defaming her, the Kuwaiti Criminal Court ruled the criminal judiciary does not have the jurisdiction to hear the case. According to the plaintiff, the defendant filmed her dancing indecently in a restaurant in a Gulf country and in a chalet in Kuwait without a hijab, and then sent two clips of her to another Gulf national who had a relationship with her, without her knowledge or consent, in an attempt to offend and harm her.

The plaintiff stated that the accused deliberately insulted and defamed her through communication devices and means using which she took two video clips of her in which she appeared in an indecent manner and sent them through instant messaging application WhatsApp in order to offend her modesty and harm her honor.

Lawyer Shahad Khaled Al-Khalidi, representing the defense, argued during the court session that the criminal elements were missing and the accusations leveled against her were malicious. According to article 11 of the Kuwaiti Penal Code, the court lacks jurisdiction to hear the dispute since the incident occurred outside the territory of Kuwait. According to her, the investigation by the incident officer confirmed that the incident took place outside the country.
