Article 70 States That Weekends, Public Holidays And Sick Leaves Should Not Be Considered As Part Of The Annual Leave

A decree was issued concerning the approval of the Council of Ministers to amend some provisions in Law No. 6/2010 concerning the private sector labor.

This includes changing the last paragraphs in Article 51 and Article 70 of the law. The last paragraph of Article 51 is related to social security.  It indicates that an employee is entitled to full indemnity after years of service without deduction of the amount borne by the office due to subscription of the worker in the Public Institution for Social Security while in service.

Article 70 states that the employee has the right to paid annual leave not less than 30 days and he is entitled to take leave in the first year after a minimum of six months at work under the employer.

Weekends, public holidays and sick leaves should not be considered as part of the annual leave. The employee has the right to fractions of the year within which he worked for the employer, including the first year in service.

The explanatory memo contains objectives for imposing protection of employee with emphasis on guarantees. This is in addition to protecting financial rights of the employee, as well as ensuring equality between private sector employees and their counterparts in the public sector.
