Kuwaiti Gets Life In Jail For Kidnapping, Raping Boy
In the first final ruling issued to implement the penalties of the Child Rights Law, the Court of Cassation sentenced a 21-year old Kuwaiti citizen to life imprisonment for kidnapping and assaulting a minor with deception.
The accused allegedly kidnapped and sexually assaulted the minor boy, blackmailed him several times, practiced psychological abuse against him and prevented the victim from obtaining his right to protection from moral and sexual abuse. The Public Prosecution conducted its investigations in the case, after the victim’s father submitted a report, accusing the citizen of kidnapping his minor son and committing indecent assault on his honor.
The suspect was arrested and charged, and then the case was referred to the court, which sentenced him to life imprisonment. The prosecution charged the accused with kidnapping the minor victim through means of a ruse by luring him to go with him and violating his honor under duress, as he did not have the willpower due to his young age.
The defense counsel of the victim, during the court session, explained that the accused had intended to violate his client’s honor. The crime was proven against him with sufficient evidence to judge his conviction.
Also, the crime of indecent assault committed by the accused had fulfilled its material and legal elements as shown in the investigations and mentioned in the forensic report. He said the accused should be criminally punished according to the articles of the indictment, because he committed the crimes that are the subject of the present criminal case and that the elements of criminal responsibility were available to him.
