Speaker Announces Vacancy Of Bader-al-dahoum Seat
National Assembly Speaker Marzouq Al-Ghanim opened the legislative session on Tuesday with the announcement of the vacancy of Dr. Bader Al-Dhahoum’s seat, whose membership was revoked by the Constitutional Court.
Al-Ghanim, in a speech, informed His Highness the Prime Minister of this measure to take the subsequent constitutional measures. Al-Ghanim added announcing vacancy of the seat was “based on the ruling by the Constitutional Court on March 14, which included three matters.” He went on to say the ruling annulled Al-Dahoum’s membership which he won on general elections on December 5, 2020 in the fifth constituency, thus his membership ceased to be valid.
As a result of the ruling, he said, a by-election should take place in the fifth constituency to fill the parliamentary seat. According to Article (84) of the constitution, if a seat in the National Assembly becomes vacant before the end of the term for any reason, the vacancy shall be filled by election within two months of the date of the announcement of this vacancy, and the term of the new member shall be until the end of the term of his predecessor. “If the vacancy occurs within the six months preceding the end of the legislative session, no replacement member shall be elected.” Also, Article (18) of the Assembly bylaw requires, if a seat of the National Assembly becomes vacant before the end of the term for any reason, the Council announces the vacancy, and the Speaker must immediately inform the Prime Minister of this vacancy to elect another member in accordance with Article 84 of the Constitution.
