Misdemeanor Court Acquits Citizen Of Raping Iran Woman
The Misdemeanor Court acquitted the female owner of a company specialized in reserving properties, hotels and clinics as well as an employee of the company of swindling a person. The Public Prosecution charged the two defendants of swindling a person by telling the latter that he will receive gifts and health insurance cards if he buys a flat in Turkey through the company. They received monthly installments from him as shown in the case files. The plaintiff told investigators that he received a phone call from the company where the defendants persuaded him to buy the gifts and cards for KD 3,900 in addition to a one-time payment of KD 175. He decided to sell the flat later but he found out that the company changed its address, so he could not sell the flat nor take his money back. Attorney Ali Al-Selaili, who represented the defendants in court, pointed out that the plaintiff signed the reservation contract for the flat, not the purchase contract. He added the contract stipulates the right of the buyer to benefit from the flat for 25 years, not to buy it. He also argued that articles 231 and 232 of the Penal Act are not applicable to the lawsuit as it did not define the means of swindling or methods of taking the victim’s money.
Not guilty in rape: The Court of Cassation upheld the Appeals Court’s decision to acquit a citizen of raping an Iranian woman, after the Court of First Instance sentenced him to five years in prison, reports Al-Anba daily. Case files indicate the woman filed a complaint at a police station against the citizen accusing him of molesting and raping her while she was heading to her car in front of a commercial establishment in Egaila. However, the defendant’s lawyer, Attorney Hussain Al-Osfour, argued in court that the accusation is baseless.
‘Royal’ acquitted: The Court of Appeals chaired by Judge Nasr Al-Heid upheld verdict of the Court of First Instance that acquitted Sheikh Meshal Al-Malik of violating national unity law in a lawsuit filed against him by the Diwan Amiri. The Public Prosecution Department charged Sheikh Al-Malik for disdain against the Shiite and urban Kuwaitis within the society when he purportedly called for the formation of the Council of Tribal Sheikhs.
