Courts Rule In Doctors' Favor And Punish Attackers
A number of verdicts were issued by the Criminal Court and the Court of Appeals convicting people accused of assaulting doctors while they were performing their duties. Lawyer Elaf Al-Saleh filed these lawsuits on behalf of the Kuwait Medical Association.
A woman was fined KD 5,000 by the Court of Appeals for assaulting an expatriate doctor, detaining her in the ultrasound room after she became angry and refused to undergo tests before the ultrasound. It fined her and referred the case to the civil court with jurisdiction.
Second, the Criminal Court acquitted an Egyptian doctor and fined a citizen KD 2,000 after they had an altercation in which the patient assaulted the doctor.
According to Lawyer Elaf Al-Saleh, her client, the doctor, was assaulted publicly, and the medical report and witness testimony support her claim.
The Court of Appeals ruled in the third case to issue a suspended prison sentence of two years against a citizen, releasing him on bail of KD 500 and requiring him to maintain good conduct for a period of three years. An expatriate doctor was publicly assaulted by this citizen while performing his duties.
The Misdemeanor Court fined a woman KD 500 for insulting a Kuwaiti doctor at Farwaniya Hospital.
According to Lawyer Elaf Al-Saleh, she is continuing to represent the Kuwait Medical Association in filing complaints against those who assaulted medical staff and doctors in various hospitals.
In addition to the deterrent penal rulings, she stressed that large sums would be awarded for psychological and moral damages.
Elaf Al-Saleh called on the Ministry of Health and the Ministry of Interior to strengthen security in hospitals by increasing the presence of police officers and security guards.
