Court Has Upheld The Right Of A Female Patient To Sue Moh For A Medical Error

The Administrative Court has upheld the right of a female patient to sue Ministry of Health for a medical error represented by leaving behind a needle in the patient’s stomach. Lawyer Abdulaziz Al-Banwan, the plaintiff counsel, stated in the lawsuit that his client went to the government hospital for a surgery, which lasted for 12 hours and raised concerns among her relatives, especially since she underwent a similar operation two years ago but it did not take such a long time back then. It was then discovered that the surgeon committed a dangerous medical error by leaving a needle in her stomach. He had discovered the error after taking an X-ray. The hospital then insisted on conducting another surgery for removing the needle.

However, that surgery turned out to be a failure as the needle still remained in his client’s stomach. The condition of his client was worsening as she started suffering from breathing difficulty. Several parts of her body started swelling and she also incurred pneumonia. Lawyer Al-Banwan urged the court to refer his client to the Forensic Department for a report on the harms she sustained because of this medical error and to decide the level of disability rate she suffers from. The court agreed to the lawyer’s request, affirming that the doctor and the hospital are responsible for the medical error.
