Construction And Contracting Companies Eye Dispute Resolution Mechanism
In Kuwait, the Municipal Council approved Munira Al-Amir's proposal to establish a mechanism to resolve disputes between contractors and construction companies, as well as between citizens and within the municipality. The decision issued by the municipality regarding the proposal included:
Creating a committee headed by the deputy director general for Survey Sector Affairs, with members comprising safety license observers from Ahmadi and Farwaniya municipalities, Noha Al-Majed and Ahsan Al-Saffar from the Legal Department, as well as the Head of the Department for Deformities and Temporary Offices in Urban Planning and Structural Planning.
Munira Al-Amir commented on the adoption of her proposal by saying, "The adoption of my proposal for resolving disputes is a positive step that supports the reduction of disputes between companies operating in the field of construction and contracting, and between citizens and owners of construction projects."
Considering that the construction sector is one of the main engines of the economy in any country, she stressed the need to resolve any problems that may arise within it and among its concerned parties as soon as possible. The completion and implementation of projects must be accelerated, as well as the number of projects that must be completed at the same time, and this is an essential objective. Al-Amir explained that the committee, which the municipality issued a decision to form, will, in its first session, establish mechanisms for the procedures that should be followed in the event of a dispute between citizens and contracting and construction companies, as well as provide recommendations for resolution.
When necessary, the committee is also entitled to seek assistance from specialists and those with experience in order to provide realistic and appropriate solutions to the parties involved in the dispute. A positive aspect of the issuance of this decision is the municipality's desire to intervene through its tools to help in this important and necessary area. This is evident from the fact that the decision will be activated from the date of its issuance until the end of the fiscal year on March 31, after which the step will be evaluated and developed.
