Case To Evict Kuwaiti Woman From Shop By Real Estate Co. Dismissed

Commercial Circuit at the Court of Appeals chaired by Counselor Haitham Al-Etaiqi with jury members Judge Muhammad Jabr and Judge Abdulfattah Al-Sharqawi upheld the decision of First Instance Court and dismissed a lawsuit filed by a real estate company to evict a Kuwaiti woman from a shop.

The lawsuit was based on a contract the company signed with the Ministry of Finance represented by the Department of State Property Contracts to carry out maintenance works and develop the market. According to the case file, the company discovered that the woman has been occupying the shop illegally, so she was issued an eviction notice and requested to evacuate the property within a specific period. However, the step was taken to file the lawsuit against the woman when she refused to leave.

Attorney Dalal Al-Mutairi in defense of the woman during the First Instance Court session argued that the lawsuit was filed earlier than the allowed period. He went ahead and solicited the court to dismiss the lawsuit. The company appealed the decision but the attorney provided a memorandum supported by relevant documents, which showed the decision issued by First Instance Court was correct and in line with law.
