The Civil Service Clarifies The Cash Allowance Procedure For Leave Balances
The Civil Service Commission has issued clarifications regarding the process for disbursing cash allowances for the balance of periodic leaves during service, highlighting that it does not solely depend on the submission of an application. In an official correspondence directed to the Undersecretary of the Ministry of Health, obtained by Al-Jarida, the Commission delineated the procedure outlined in Civil Service Council Resolution No. 2 of 2022, subsequently amended by Resolution No. 32 of 2023.
The letter outlined that the decision to disburse the cash allowance is made by the Undersecretary of the Ministry or the head of the independent entity, adhering to the rules, conditions, and controls specified in the resolution. While submitting an application is an initial step, the crucial determinant rests upon the decision issued by the competent authority.
Moreover, the correspondence addressed the management of cumulative balances of periodic leave for non-Kuwaiti employees whose leave balances surpass the legally prescribed limit. It specified that if the allowance is not disbursed, the balance of periodic leave will be refunded and managed according to Civil Service Council Decision No. 102 of 2021, which freezes the balance of periodic leave for the years 2020 and 2021.
The Commission stressed the importance of implementing periodic leave provisions and the calculation process, including the integration of data into civil service systems. It underscored the necessity of adhering to the relevant resolutions in disbursement procedures, highlighting that mere requests will not suffice without adherence to the established guidelines.
