Man Freed In Violent Theft Of Car And Beating Cops By The Court
The Court of Cassation canceled the verdict of a lower court which sentenced an individual to five years imprisonment for stealing a vehicle using violence, resisting security personnel, and assaulting them. The court instead acquitted him due to the lack of the elements of the crime and their proof against him, reports Al-Seyassah daily.
The Public Prosecution had charged the accused with stealing a vehicle using violence and threatening to use a sharp instrument (a cleaver) against its driver. He was also charged with deliberately damaging – and with intent to harm – the vehicle and the police patrol owned by the Ministry of Interior, resulting in material damage. The Public Prosecution stated that the accused assaulted and resisted with force and violence the police officers who were on duty. He recklessly and negligently drove the vehicle, exceeding the maximum speed limit and causing danger to others. He violated the traffic law and its executive regulations, which led to an accident that harmed private property. He drove the vehicle without the knowledge and consent of its holder and owner.
During the court session, the defense counsel lawyer Abdullah Al-Alanda said the elements of the crime of theft were absent against his client and that he did not have criminal intent. He stressed that the incident officer presented an incorrect picture of the facts of the case, taking from the statements of the prosecution witnesses despite their lack of credibility and contradiction. It was also established that the court was certain that the elements of the crimes attributed to the accused were not available and that they were proven against him, as long as it concluded with the use of clemency towards him.
