Former Chairman Of KAC Case Is Dismissed By The Court

Yousef Al-Jassem, former Chairman of the Board of Directors of Kuwait Airways, was ordered to return the amount of KD 243,000, which represents the value of the allowances he had unjustly received, by the Court of Cassation overturning the verdict issued by the Court of Appeals and the Court of First Instance.

Kuwait Airways Corporation's lawsuit was instead rejected by the court. Commenting on the ruling, Al-Jassem said, “We thank Allah for the ruling. I appreciate and honor the Kuwaiti judiciary, its justice and integrity, which is a reference for all of us in obtaining our rights. In its fair and final ruling, the court dismissed the lawsuit filed against me as former Chairman of the Kuwait Airways Corporation Board of Directors between April 1, 2018 and August 13, 2020. The former Minister of Finance and Chairman of the Board of Directors of the Public Authority for investment Dr. Nayef Falah Al-Hajraf granted me allowances at the time.

My honorable judiciary, whose justice we seek to protect in our dear homeland Kuwait, has done justice to me before Allah and all people in accordance with the just ruling issued by the Court of Cassation. It affirms the values of integrity, honesty, competence, and dedication that I grew up with throughout my personal and professional career of more than fifty years in Kuwait Airways Corporation and the other entities where I worked, maintained their trusts, and maintained their systems and laws. That was witnessed by everyone."

The judiciary and the lawyers who defended Al-Jassim voluntarily or on retainer were thanked by Al-Jassim. He also expressed his gratitude and appreciation to “my brothers, sons, family and honorable friends in Kuwait who supported me during periods of litigation and were my best support and helper after the Almighty. I tell those who exploited the case and sought to harm my professional and personal reputation for their own ends that Allah is sufficient for us, and He is the best administrator."

According to informed sources, the Kuwaiti judiciary is fair, while at the same time highlighting the arbitrariness of Kuwait Investment Authority, which is responsible for Kuwait Airways. Kuwait Airways filed the lawsuit, challenging the role of the legal administration, accusing others and preoccupying the judiciary. In a lawsuit filed against him by Kuwait Airways at the end of 2021, the Court of Appeals upheld the ruling of the Court of First Instance, requiring him to return this amount, which represents the value of salaries and benefits he received "unjustly."
