Court Quashes 3-1/2 Year Imprisonment Against 2 Kuwaitis And A Female Compatriot In Drug Case
The Court of Appeals overruled a lower court verdict that sentenced two Kuwaitis and a female compatriot to three years and six months in prison with hard labor. The court instead acquitted them of the possession of brain stimulants and hashish for consumption purpose.
On the day of arrest, police officers responded to report about a fight at the parking lot of Salwa Cooperative Society involving three people who appeared to be intoxicated and completely disoriented, while one of them was bleeding from an injury in his hand.
The officers restrained them, and before being cuffed, found two pills believed to be brain stimulants on one of them. The discovery prompted the officers to conduct a search in their car where hashish and other tablets were found.
Representing one of the defendants, Attorney Ali Al-Alanda argued that his client’s car was searched illegally by the officers, given that they did not obtain permission from the concerned authority to allow them to do so. Attorney Al-Alanda indicated that his client was detained out of suspicion, while evidence presented by the prosecution was inadmissible due to the fact it was gathered illegally.
