Court Of Cassation Has Laid Down A New Principle

The Court of Cassation has laid down a new principle with a recent ruling ordering the Ministry of Finance to refund extra KD 10 per square/meter of plot collected from land owners based on Law No. 8/2008 that replaced Law No. 50/1994, indicating funds collected by the ministry violated the legal exemption for 5,000 square/ meters area. Lawyer Mohammad Al-Rushaid stated Law No. 50/1994 stipulated the provision of services and all facilities, including electricity, water, drainage system and telephone but the amended Law No. 21/2010 was silent about the types of services and facilities, which opened the door for various efforts to interpret ambiguities in the new law. The Cassation Court’s judgment made necessary clarifications after several years of litigation, saying plots that were not connected to power are not liable to paying fees.
