Amendment To Real Estate Lease Law Will Be Included On Tuesdays Session For Discussion
The Legislative and Legal Affairs Committee has completed its 36th report on proposals by laws to amend some provisions of Decree Law No. (35) for the year 1978 regarding renting real estate, and they number (4) proposals, and it was included in the agenda of Tuesday’s session in preparation for consideration by the National Assembly
First Article: A new paragraph is added to Item No. (1) of Article (20) of Decree Law No. (30) for the year 1978 referred to as follows:
Article (20)
“In all cases, it is not permissible to order the eviction of the leased property if the tenant fails to pay the rent during the period which the Council of Ministers decides to suspend or suspend work in all public facilities of the state in order to protect the security, public peace or public health which is in the interest of the country, provided that the court determines the way the tenant pays the late rents according to the circumstances of the lawsuit.
Second Article: The text of the first and second paragraphs of Article (24) of Decree Law No. (30) for the year 1978 referred to shall be replaced by the following text:
Article (24): “The real estate rental issues court shall be established by a single court that includes one judge, and it includes one or more rooms according to the need is exclusively for the resolution of disputes related to rents, whatever their value and the compensation arising from these disputes.
Article Three: A new article with the number (26 /D) is added to Decree Law No. (30) for the year 1978 referred to as follows:
Article (26) (d)Fourth Article: The Prime Minister and the Ministers – each within his jurisdiction – must implement this law, publish it in the Official Gazette, and take effect from 12/3/2020.
