Jail And Fine Overturned By Court
The Misdemeanor Section at the Appeals Court overturned the ruling of the First Instance Court which fined a citizen KD500 and ordered the cancellation of his driving license for one year for driving under the influence of alcohol and hitting a concrete fence.
The higher court acquitted the citizen. The concerned securityman said he received a call from the Operations Unit informing him about car in reverse direction. He added that when he approached the driver and talked to him, he found out the driver was drunk so he arrested him.
The accused refuted the statement of the securityman that he admitted possessing the cup and alcoholic drink found in his car, stressing that the items belong to his friend. He added that his car rammed into a concrete fence in the Free Trade Zone.
Attorney Abdulmuhssen Al-Qattan, who represented the citizen in court, argued the arrest and search procedures were illegal as they were taken without a warrant from the Public Prosecution and that his client was not caught red-handed.
Gang aquitted: The Court of Appeals cancelled the decision of the First Instance Court which sentenced seven citizens to four years in prison, and then acquitted them of possessing drugs for consumption and trafficking. The Public Prosecution charged the accused with possession of drugs for consumption and trafficking after their arrest at a livestock pen in Kabad. One of the accused testified that on the day of the incident while he was in the livestock pen with his friends, they heard someone shouting asking them to come out. Then two sound bombs were thrown at their direction, so they came out except one friend who was fast asleep. He added the securitymen handcuffed them, searched the place and took the keys of their cars. He said the confiscated items were found outside the car owned by another accused and was parked in front of the livestock pen. He continued saying that they were taken to the police station where they denied any relation to the confiscated drugs. Attorney Abdullah Al-Alanda, who represented the accused in court, pointed out that the warrant issued by the prosecution was illegal as it was based on inconclusive investigations. He also raised doubt on the consequent procedures
