Fake ‘Sheikh’ Sentenced To 2-yr As Court Overturns Verdict

The Court of Appeals overturned the verdict issued by a lower court which acquitted an imposter. The court instead sentenced him to two-year imprisonment with hard labor for assuming the status of a ruling family member, deceiving a Kuwaiti woman, taking her money, and tricking her into buying a chalet in Mina Abdullah. The Public Prosecution charged the accused with seizing money from the victim after deceiving her by claiming he is a member of the ruling family, taking the name of a “sheikh”, and claiming that he could allocate lands owned by the state. Based on that illusion, he was able to seize her money. He was also charged with deliberately misusing a means of communication (smartphone) to commit the crime subject to the first charge, as shown in the investigations.

During the court session, the victim’s defense counsel Lawyer Abdul Mohsen Al-Qattan argued a civil claim for the amount of KD 5,001 as temporary civil compensation, stressing that the accused had committed crimes similar to the accusations leveled against him in the present incident. Referring to the case papers that are the subject of the present accusation, Lawyer Al-Qattan said, “We find that the crime of fraud, with all its legal elements and aspects, was committed against the accused, namely that the accused deceived the victim. It is legally stipulated that to create fraudulent methods, methods, and measures must be used in the form of external appearances or actions that the offender intends to tailor to support his statements and to make his fraud and deception appear true. The lying committed by deception reaches the category of fraudulent methods if it is accompanied by material actions or external facts that lead to belief in its authenticity. Among these are the fraudulent methods stipulated by the law, in which the act of fraud is carried out by the illusion of the existence of a false project to create hope of an imaginary profit or to create a document that has no truth or other methods specified by law.”
