Expat Acquitted In ‘terror’ Case; Appeal Overturns 3 Years Jail
The Court of Appeals overturned a verdict issued by a lower court which sentenced an expatriate to three-year imprisonment with hard labor, and instead acquitted him of the State Security charges of being associated with suspicious elements and possessing a Kalashnikov firearm. According to the case file, a Kuwaiti citizen was summoned to the State Security Department for investigations on his link with suspicious elements.
When confronted, he revealed that he possesses a Kalashnikov type firearm, which he obtained from the expatriate, and that it is in his camp in Salmi area. Accordingly, a permit was issued to seize the expatriate and to search the camp. In implementation to the Public Prosecution’s decision, the camp was searched and the firearm was found. From his residence, 28 rounds of live ammunition, 9 mm type, were found in a safe inside the bedroom.
The defense counsel Lawyer Jarrah Al-Shareka said the documents are devoid of any specific evidence against his client, except for non-serious office investigations conducted by the detective officer. He stressed that the statements that were sent did not rise to the level of reason and logic proven in the list of prosecution witnesses, or it is dropped from the names of the individuals who witnessed or may have witnessed the incident. Lawyer Al-Shareka stressed that his client is nothing but a shepherd and not a sponsor of suspicious groups or an arms dealer. He said that it was confirmed from the investigations that there was no single witness to the occurrence of the incident and that it was devoid of proving the existence of the elements of the crime of arms trafficking against him.
