Court Ordered The Referral Of The Doctor For A Criminal Trial
The Appellate Circuit of the Misdemeanor Court cancelled the decision issued by the Public Prosecution to set aside the case famously known on social media as the “Liposuction Doctor Case.” The court instead ordered the referral of the doctor for a criminal trial.
According to the case file, a video clip was posted on social media which revealed the doctor, a cosmetic surgeon, showing the body parts of a female patient during a liposuction operation.
The patient, through her lawyer Latifa Al-Yahyouh, filed a case, expressing her client’s grievances in being exposed on social media where all sorts of mean comments were made in response, which in turn tarnished her honor and image as a result of the act of the doctor in shooting the video. She said her client never agreed to have such a video broadcasted on social media.
;The prosecution summoned the doctor and conducted investigations with him but it issued a decision to set aside the complaint due to lack of incriminating justifications, based on the victim’s signature on the contract of the hospital which states in one of its provisions that the hospital has the right to record the operation.
The Prosecution’s decision did not sit well with the victim, so she filed the case through her lawyer. The court said the Prosecution erred in issuing the decision because the contract says the hospital has the right to record operations for scientific purposes and studies which is legally allowed. However, it does not say the hospital has the right to publish the video on social media to defame and tarnish the image of patients. The court found the prosecution’s decision in violation of the relevant laws.
