The Appeals Court Overturns The Lower Court's Ruling On The Travel Ban

The Court of Appeal has overturned a previous verdict that imposed a travel ban on a Kuwaiti citizen accused of failing to repay a debt of 38 thousand dinars to the state.

Attorney Mustafa Mulla Youssef, representing the plaintiff, argued before the court that the conditions outlined in Article 297 of the Code of Procedure for issuing a travel ban were not met in his client's case. These conditions include the ability to pay and the existence of serious reasons to flee the country.

In its ruling, the court concluded that the debtor's delay in repaying the debt, either in full or part, does not necessarily constitute a rational basis to suspect an intention to escape the debt.
