Kuwait Implements New Labor Market Measures: No Additional Fees for Expatriates Over 60 & Easier Worker Transfers

The Public Authority for Manpower (PAM) has introduced new regulations designed to streamline procedures and boost flexibility in Kuwait’s labor market. This move aligns with the objectives outlined in Ministerial Decree No. 12 of 2024, as reported by Al Anba newspaper.

Key Changes to Work Permits and Expatriate Worker Regulations

In a significant policy shift, the authority announced the cancellation of a previous decision requiring expatriate workers aged 60 and above to pay an additional fee and provide a health insurance policy. This change, as directed by Sheikh Fahad Al-Yousef, the First Deputy Prime Minister and Minister of Defense and Interior, will ease the financial burden on senior expatriate workers. Moving forward, work permits will be issued under ordinary fees, without additional requirements.

Changes to Labor Transfer Rules for Small and Medium Enterprises (SMEs)

The new measures also include a reduction in the waiting period for labor transfer within the small and medium enterprises (SME) sector. Previously set at three years, the duration for transferring workers within the sector has been shortened to just one year. However, this transfer is limited to SMEs and requires the approval of the registered entrepreneur.

Enhanced Flexibility for Employers to Recruit and Transfer Workers

The Public Authority for Manpower has lifted the ban on transferring workers from the lists of distinguished individuals. This development enables employers to recruit foreign labor or facilitate internal transfers with greater ease, enhancing market flexibility.

Immediate Worker Transfer for Project Owners

In addition, project owners now have the option to transfer workers from one of their projects to another within the SME sector immediately, without the previously required one-year waiting period. However, this transfer option comes with a fee of 300 Kuwaiti dinars.

Enhancing Kuwait’s Labor Market Efficiency

These changes are part of the Public Authority for Manpower’s ongoing efforts to improve the efficiency of Kuwait’s labor market, ensuring a flexible and secure environment in line with the country’s goals for sustainable development.
