Government Agencies To Track The Movement Of Employees Violates Privacy
A number of jurists are of the opinion that the decision of the government agencies to track the movement of employees – their entry or exit from the land and air ports – may need approval of the judiciary, reports Al-Rai daily.
At the same time, they noted that “the process of tracing employees on sick leave violates the right of privacy as per the Constitutional Court. The legal assertions came against the backdrop of what was said about a trend to launch a system that will allow tracing the movement – entry and exit – of state employees by establishing a link between land and air ports. “There is a right to privacy that was decided by the Constitutional Court when it was presented with a parliamentary query in this regard, and the court decided that the right to privacy is related to the elements of private life,” said the constitutional expert.
Kuwait University Law Professor Ibrahim Al-Hamoud said “obtaining sick leave does not preclude freedom of travel and travel stipulated by the constitution. Tracing is a violation of privacy and an attack on a constitutional right.”

The patient is entitled to travel and does not require taking sick leave to stay in the state. He concluded by saying that “tracking the travel of employees is done by the judiciary and not the government bodies, there must be permission from the judiciary, which will issue this permission only if it was provided by convincing reasons.
