Nationality Of 20 Persons Not Reinstated - Ruling Overturned

The Court of Appeals has overturned the verdict issued by the Administrative Court which obligated Ministry of Interior to return Kuwaiti citizenship to 20 members of a family who were accused of obtaining the citizenship through forgery, reports Al-Qabas daily.

The verdict issued by the Court of First Instance Court had obligated Ministry of Interior to return the revoked citizenships. This verdict was issued in line with the authority of the court to judge lawsuits concerning citizenships.

In the last session of the Court of Appeals, counsel to the government Lawyer Ali Al-Munawer said the verdict issued by Administrative Court is no longer valid on the basis of the Kuwaiti law and the judiciary regulations.

He stressed that the recent verdicts indicate the judicial authority is not authorized to judge cases related to citizenship.

Lawyer Al-Munawer explained that the parliamentary session held on April 12, 2017 did not accept the proposal presented by a number of MPs for amending item No. 5 of article 1 related to citizenships. This stance reflects the lawmakers’ point of view not to include citizenship cases under the authority of the judiciary.
