MoSA Calls On Municipality To Enforce Laws Against Violating Charity Branches
The Ministry of Social Affairs has officially instructed the Kuwait Municipality to take action against violations committed by the branches and committees of public benefit associations and charitable foundations. These violations, occurring within private and model residential areas, have raised concerns over compliance with existing regulations.
Legal Framework for Charitable Activities in Kuwait
The Ministry highlighted the importance of enforcing laws that govern charitable activities, particularly those under Law No. (24) of 1962, which pertains to clubs and public benefit associations. This law lays the foundation for the regulatory supervision of such organizations in the country.
Ministerial Resolution No. 2009/206: Prohibiting Non-Residential Use of Residential Buildings
As part of its directive, the Ministry referenced Ministerial Resolution No. (2009/206), which regulates construction within residential zones. The resolution prohibits the use of private residential buildings for non-residential purposes, including the operations of charitable organizations. This regulation ensures that residential areas remain undisturbed by non-residential activities.
Cabinet Decision No. 867: Legal Classification of Charitable Committees
Additionally, the Ministry called for the enforcement of Cabinet Decision No. (867), which mandates proper legal classification for charitable committees and branches. This decision helps ensure that these organizations comply with the legal standards required for their operation and address any irregularities regarding their status.
Importance of Coordinated Efforts for Compliance
The Ministry emphasized the need for a collaborative approach between relevant authorities to ensure the consistent application of the law. By working together, these agencies can address the unauthorized activities and bring charitable organizations into compliance with established legal frameworks.
