Kuwaiti Court Orders Contracting Company to Pay Citizen KD 35,000 for Breach of Contract

A Kuwaiti court has ruled in favor of a local citizen, ordering a contracting company to pay 35,000 Kuwaiti dinars, along with 7% interest from the date the lawsuit was filed until the full settlement. The judgment was issued after it was established that the company had failed to fulfill its contractual obligations regarding a construction project.

Failure to Meet Contractual Obligations

The Kuwaiti citizen had entered into an agreement with the contracting company to carry out construction work on his property per agreed technical specifications and timelines. However, the company did not comply with the contract, resulting in legal action to safeguard the citizen’s rights.

Legal Proceedings and Expert Testimony

Seeking legal recourse, the affected party enlisted the expertise of attorney Dalal Al Mulla, who promptly filed a lawsuit. As part of the proceedings, a technical expert was appointed to evaluate the condition of the property. The expert’s report confirmed that the work conducted by the contracting company was defective, incomplete, and in violation of the contract.

Court’s Decision and Financial Compensation

Upon reviewing the expert’s findings, the court referred the case to a substantive case expert, who determined that the company’s negligence was evident. Consequently, the court ruled that the Kuwaiti citizen was entitled to financial compensation, including interest for delayed payment, effective from the lawsuit’s filing date until the complete settlement.
