Kuwait Updates Weapons Law to Address Surge in Bladed and Air Weapon Violence

In response to the rising use of bladed weapons and air rifles in acts of violence and intimidation, the Kuwaiti government has issued a new decree-law amending several provisions of Decree-Law No. 13 of 1991. This legislative overhaul reflects the state's commitment to enhancing public safety and adapting laws to modern threats.

Purpose Behind the Amendments

The explanatory memorandum accompanying the decree underscores the need to curb the misuse of non-firearm weapons. The revised legislation aims to impose stronger legal controls on the possession and use of these weapons. The ultimate goal is to ensure both general and specific deterrence, thereby reinforcing public order and societal security.

Key Legislative Changes

New Title Reflecting Expanded Scope

Under Article 1, the law has been renamed:
“Law regarding weapons, ammunition, bladed weapons, and dangerous air weapons”.
This change reflects the broader range of weapon types now subject to regulation.

Revised Provisions Under Article 2

  • License Requirement: Individuals are strictly prohibited from possessing or acquiring any type of weapon or ammunition without a valid license from the Minister of Interior or an authorized delegate. Authorities reserve full discretion to refuse, revoke, or restrict licenses at any time.
  • Restricted Weapon Use in Certain Areas: The use, possession, or acquisition of dangerous bladed weapons or air weapons is banned in prohibited zones unless justified by personal or professional necessity.
  • Complete Prohibition on Heavy Weapons: The acquisition or use of cannons, machine guns, or silencers is absolutely prohibited, regardless of the circumstances.

Impact and Implications

This legal update represents the first major reform in over three decades to Kuwait’s weapons legislation. It brings the regulatory framework in line with current security challenges and growing societal concerns about violence. By tightening control over non-firearm weapons, the decree seeks to limit potential threats and deter unlawful behavior.

The strengthened regulations are expected to assist law enforcement in reducing violent crime rates and maintaining peace, particularly in urban areas where such weapons have been misused.
