Workers Who Violate Provisions Of Labor Law Face Two-year Ban - Pam
The Public Authority for Manpower (PAM) is determined to uphold its right to deprive a worker from obtaining a work permit for at least two years if he/she is found to have violated the provisions of the Labor Law or the labor contract.
PAM continues to put in place strict procedures to help prevent violation of the labor law. In this context, PAM plans to punish the violators which include provisional suspension of the employer from recruiting personnel, followed by permanent suspension and referral to the judiciary.
The authority explained the concerned department may suspend the employer provisionally until the violation is corrected, while giving the department director the authority to lift the suspension temporarily to grant the employer time to amend the situation.
The authority shall also have the right to close the file temporarily or permanently depending on the gravity of the violation (fraud, or forgery in the data submitted to PAM), which harms the public interest and tarnish the reputation of Kuwait.
On the other hand, PAM has determined the reasons that allow the employer to file a notice of absence against the worker following ‘no show’ by the worker for seven consecutive days. In this case the employer is obliged to submit to the Ministry of Interior within 15 days details about the employee concerning absenteeism in a conspicuous manner until verifying the authenticating the report.
