The Kuwait National Assembly Approves Proposals For Laws Regarding Demographics In Their First Discussion
The Kuwait National Assembly approved in the first deliberation the proposals for laws regarding the demographic composition, including addressing the imbalance of demographics, controlling employment rates and organizing their presence in the country in a manner that does not affect the economic, social and service aspect.
The result of voting on proposals for laws in the first deliberation of the special session of the Council today, Tuesday, was approved by 29 members and 12 of the 41 members in attendance rejected.
The National Assembly moved in its session today to discuss the report of the Parliamentary Human Resources Development Committee on the proposals for laws regarding the issue of demographics, which number eight, proposals for laws.
With reference to the explanatory memorandum, this law was prepared based on the demographics as an important national issue, as it clarified in one of the articles the definition of the most important terms and expressions contained in the law and indicated in another article the scope of its provisions.
In one of the articles, the Council of Ministers must issue within six months a decision that includes the maximum number of expatriate workers in a manner that preserves the relative weight of this workforce as a whole to the number of citizens and the relative weight of each nationality separately.
In the interest of the efficiency and quality of labor, the same article added a new commitment to establish a mechanism for testing employment to ensure the required qualifications, experiences, specializations, professions, crafts and various jobs in a manner commensurate with the country’s needs.
Emphasizing the importance of addressing the imbalance, following it up, and delivering its results, the article also provided for the issuance of these decisions annually, and to ensure knowledge and enhance transparency, the article required the publication of these decisions in the Official Gazette.
Another article regulates the general frameworks that are taken into account when determining the rates of expatriate workers. As for one of the articles, it defines the categories excluded from the maximum labor force imported from abroad, taking care to keep the text flexible by allowing the Council of Ministers to decide to exclude any other category that is not mentioned in the text of the article in order to achieve the public interest .
Another article came to reconcile the conditions of expatriate workers in excess of the needs of the labor market by setting a time restriction estimated at five years during which either the residency of the workers who are in excess of need is terminated or they are allowed to license and renew the residency in the event that the conditions and controls specified by the executive regulations are met.
One of the articles indicated the procedures that are prohibited from approval of procedures that may lead to labor leakage between entry features, work sectors, projects and government contracts, while another article punishes those who violate this ban
