The Amiri Pardon Committee Approves The Amnesty Rules For 2021

The head of the Supreme Committee for Amiri Pardon, Counselor Muhammad Al-Duaij, announced that the committee has formally approved the amnesty rules for the year 2021, in implementation of the high directives of His Highness the Amir Sheikh Nawaf Al-Ahmad Al-Jaber Al-Sabah to pardon some prisoners and qualify them to be effective tools in building society.

Al-Duaij said in a press statement that the most prominent thing that was added to the new year is the approval of the electronic bracelet for simple imprisonment penalties that do not exceed a period of three years, after the release of some convicts who do not pose a threat to public security while restricting their residence to a specific range during the period of supervision until the end of The period of imprisonment determined by the sentence is similar to what is followed in many countries of the world to prevent the hardened criminals sentenced to forced imprisonment from engaging with those who do not have a history and who are sentenced to simple, short-term imprisonment.

Al-Duaij indicated that this system will be applied after the prisoner is granted an Amiri conditional pardon with a forced residence imposed on him in his home or within a specified range, allowing electronic verification that he has not left his place of residence with an electronic bracelet affixed to him to ensure that he remains in that vicinity for the period of his sentence, in accordance with the rules that will Determined by the regulations that will be issued successively.

Al-Duaij indicated that the bracelet is equipped with an electronic alert system against its removal by non-specialists, and is linked to an automatic control room to track the prisoner and monitor his movements, and in the event that he leaves the specified range without permission from the supervisory authority, his release is immediately canceled by a decision from the Attorney General and returned to his prison to complete his entire sentence.

Al-Duaij explained that this system will exclude serious and important cases, such as issues of state security, cases of assault on public funds and money laundering, noting that the Judgment Execution Department will be responsible for implementing this system under the supervision of the Public Prosecution.

It should be noted that the State of Kuwait is the first country in the Middle East to apply the alternative penalties system later during the execution of the imprisonment penalty, and not as is the case in many countries of the world from applying this system during the trial of the accused and this is an advantage and a great opportunity to study the behavior of the convict while he is in prison and before Granting him a pardon, in which he shall be under the sight and control of the Correctional Institution to indicate whether he deserves to be released on parole with the electronic bracelet or not. This is because this pardon requires the implementation of the imprisonment penalty and the convicted person entering prison for the implementation of a certain period during which he is under probation and taking into account good behavior.
