Tenant To Pay Half Rent Due To Coronavirus Pandemic

In a court ruling issued by the Rent Department of the Supreme Court, headed by Counselor Ahmed Al-Dehaishi, the court ruled against the eviction of a tenant from the leased property, for not paying the late rent for the months of January and February from the beginning of this year, and it refused the eviction ruling against him for the period from March to June last due to the conditions of the coronavirus pandemic.

The court stated in its ruling that there are exceptional circumstances that could not have been foreseen, highlighting the coronavirus pandemic, through which the public authority in Kuwait took preventive measures to mitigate the difficulties faced by some. It added the rent obligation in the lease contract of the apartment in the lawsuit has become a burden for the tenant, because he suffered financial difficulties due to the suspension of business activities, and the curfew during the period from 1/3/2020 to 6/30/2020.

Based on the defendant’s request to the property owner for a rent reduction, and after weighing the interests of the two parties, the court passed a ruling for slashing the rent to half. Although the judgment issued in the first instance from the court is subject to appeal, there is text of Article 198 of the Civil Code regarding the consideration to be taken into account for exceptional circumstances such as the coronavirus pandemic.
