Temporary Government Work Contracts To Be Limited To One Year

25 January 2021 Kuwait

A temporary government work contract limited to one year will be handed to contractors seeking expat workers for emergency government projects, which will be automatically cancelled after one year from the expiration date mentioned on the contract. This enters into force under a new rule to the set of regulations for work permits for employers as part of efforts by the Public Authority for Manpower (PAM) to fix the country’s demographics and outline a set of strong employment conditions, Al-Seyassah daily reported.

As part of the new regulations, the contractor is obliged to attach a letter detailing the number of workers and the duration of the contract, and to register the contract with the Governmental Contracts and Projects Department as well as provide a letter of guarantee regarding the recruitment of the number of workers required for the project.

PAM pointed out the government contract file is cancelled automatically after one year from the date of the contract’s expiration or after it has been granted extensions. PAM has also defined regulations for filing absenteeism reports if employers find their worker’s missing.

In the event a worker has abstained from work for consecutive days without an excuse, the employer must inform the competent department after seven days from the date of absence to apply the prescribed measures, provided the notice from the worker obtained shall also be submitted to the concerned authorities in the Ministry of Interior within 15 days from the date of its receipt, otherwise it will be considered null and void.

The regulation obliges the employer responsible for issuing an ‘absent or absconding’ report on one of its employees to display a copy of the letter in a visible place at the workplace until a decision is passed.
