New Residency Bill – Kd 4 Fine Daily For Violation, Kd 10 For Overstaying Visit, Kd 2,000 For Not Registering A Child

There is brainstorming among Kuwaiti nationals & Expatriates on New Draft of Residency which was approved by Council Of Ministers in a meeting few days back. The residency visa limits is a new course of discussion which was 5 years earlier, the same has been increased or not?

The council of Ministers is aware regarding the confusion arose in understanding the Article 13, which says ,  that that the bill mainly aims to address deficiencies and combat residency trafficking.

The fee has been increased against the Violation of Residency Law, from KD 2 to KD4 & if there is any Violation in Visit Visa, it becomes KD10.

Under the Article 13 of Residency Visa, there are few positive implications for Investors & Real Estate owners & as divorced women or widows of Kuwaiti men with children, and for the non-Kuwaiti husbands and children of Kuwaiti women, the limit of their stay has been increased to 10 Years under normal circumstances.

The new provision has been added in Article 18 & 19, these article talk about illegal human trafficking & illegal migrants, it also talks about various acts which comes under illegal approach by individuals for making illegal profits by illegal residency & Human Trafficking

According to the Draft, the domestic workers cannot move outside Kuwait for more than 4 months in a year, if he/she does the same, their visa would get cancelled automatically.

The Article 21 describes about Deportation of foreign nationals & their families and those who are assigned to support them, unless it is proved that they have a clear means of subsistence”.

The Article 22 has also been modified, the Arrest period of 15 days has been increased to 30 before deportation. 

Any foreigner who was earlier deported from Kuwait can only re-enter with mandatory permission from Ministry of Interior only, Article 26 explains. 

The foreign nationals need to submit application to get the residency visa on birth of a Child, if child is born in Kuwait, within 4 months from date of the birth, or they have to mention the time limit to leave the country. The Article 6 explains.

The paragraph 3 under Article 14 states that the Employers has to inform the Ministry of Interior, on resignation of any Domestic Worker or employee, within a weeks’ time.

According to article 27, those who violate the provisions of Articles 6, 14 (paragraph 3), 15 (paragraph 3), and 16 of the law shall face punishment of a fine not less than KD 600 and not more than KD 2,000.
