Ministry ‘warns’ Nurseries Against Flouting Decision To Shut Facilities

The Ministry of Social Affairs have warned nurseries against violating the recent Cabinet decision to close all facilities serving children, including summer clubs, until the beginning of September; indicating the punishment includes withdrawal of the license, reports Al-Jarida quoting sources from the ministry. Sources told the daily that the Council of Ministers officially informed the ministry on the inclusion of nurseries in the decision to close children facilities. Sources pointed out the excuse of some owners of nurseries that they were not provided with a copy of the decision is not valid and will not exempt them from the penalties in case they insist on continuing their operations — an act considered a violation of the Child Protection Law. Sources said Article 27 of the executive regulations of Law No. 22 of 2014 regarding private nurseries mandates the ministry to withdraw the nursery license and apply administrative closure for a period it deems appropriate in case of violating the law.

Sources added that Article 28 allows the ministry to cancel the license in several cases; including the continuation of the violation, failure to modify the situation or if such a step must be taken in the interest of the public.

Summoning
Sources revealed the ministry has started summoning the legal representatives of nurseries found to have violated the decision and issued warnings, along with signing a pledge not to repeat the violations. Sources clarified the ministry is keen on protecting the interests of the owners of nurseries, but ensuring the health and safety of the children is on top of its priorities. Meanwhile, the workshop that was held to discuss the proposal to establish nurseries in government institutions the Legal and Financial Committee of the Municipal Council is said to have given nod to the proposal if the number of female employees exceed 50 or if the number of employees exceed 200, irrespective of the gender, reports Al-Anba daily.

The proposal was put forward by Council member Maha Al-Baghli. The workshop was attended by executive members from the Kuwait Municipality and from the Ministry of Social Affairs. The idea was approved in principle; especially since it will be a big support for women especially those who want to build their career. Al-Baghli added that it has been recommended that the Ministry of Social Affairs be requested to amend the nurseries regulation to allow the proposal to be applied not only in existing buildings, but that this decision is made applicable to new government buildings, taking into account the location of nurseries from the beginning of the design and construction stages in the new buildings.
