Kuwaiti Court Acquits 4 Inmates Of Possessing Drugs In Jail

The Court of Cassation upheld the verdict issued by the Court of Appeals which acquitted four inmates of Central Prison including a Bedoun man and an expatriate who were accused of possessing drugs inside the prison. According to the case file, the incharge officer, who is the director of the Coordination and F o l l o w – u p Department at the Central Prison, testified that he carried out investigations as per which 37 prisoners possess drugs in the fifth cell of the Central Prison. After receiving a warrant from the Public Prosecution, the suspects were arrested and referred to the Criminal Investigations Department. Urine samples of four of the arrested inmates tested positive for traces of morphine. The Public Prosecution then charged them with smuggling, possession and consumption of drugs inside the Central Prison. The Criminal Court had sentenced the four defendants to five-year imprisonment with hard labor as well as a fine of KD 1,000 each. The court ordered the deportation of the expatriate and the Bedoun suspects following the completion of their prison terms. However, the defense counsel Lawyer Mohammad Hamza stressed that the Public Prosecution’s warrant was illegal as it was issued based on unserious investigations. Insisting that the urine tests are illegal because they exceeded the limits of the issued warrant, he urged the Court of Appeals to acquit his clients. The verdict of the Court of Appeals to acquit the defendants of the charges was upheld by the Court of Cassation, which rejected the appeal submitted by the Public Prosecution.
