Kuwaiti Company Obligated To Pay $3 Million Compensation To Saudi Company

Kuwait judiciary obligated a Kuwaiti pharmaceutical company to pay compensation worth $3 million to a famous Saudi pharmaceutical company for supplying medicines deemed unsafe by the Saudi authorities and confiscated by them, reports Al-Anba daily.

According to the facts of the dispute, the Kuwaiti company is an agent of several international pharmaceutical and cosmetic companies in the Middle East based on an exclusive distribution agreement within Saudi Arabia concluded between the aforementioned company and one of the major Saudi pharmaceutical companies that it exported those medicines to it.

The Saudi company had paid sums for these products but it was surprised when the Saudi authorities seized the products and ordered their destruction because the necessary medical documents and reports for the medicines, which affirm their safety, were not submitted. This was because the Kuwaiti company refused to deliver those documents. In addition, the medicines, after they were examined, were deemed to be unsafe and were thus destroyed, which seriously affected the Saudi company and harmed its reputation.

The Saudi company had resorted to its lawyer in Kuwait Lawyer Abdulaziz Saud Al-Subaie, who in turn litigated the Kuwaiti company before the court and proved with conclusive evidence that the breach was on the part of the opposing company and that it did not provide the necessary documents to register these medicines as stipulated in the contract of agreement. This is in addition to the proven unsafe medicines by means of the Saudi Medicines Authority, which confirms that the breach was on its part and that it is thus obligated to pay compensation for the damage and return the sums it received.
