Handling Smuggled Items
In response to the Unified Customs Law No. 10/2003 for the Gulf Cooperation Council nations, the Ministry of Finance's Decision No. 30/2003 on customs data and regulations, and the current customs instructions, the General Administration of Customs has issued instructions regarding the way in which reports issued about the seizure of smuggled cigarettes, their derivatives and food items will be handled at all customs ports, reports Al-Anba daily. "Kuwait Al-Youm" newspaper published instructions on customs dealing with smuggled cigarettes and food supplies. "The government will respond to smuggled cigarettes and food supplies in the following ways, according to the instructions published in the official gazette.
1. In the event that smuggled cigarettes, their derivatives and food supplies are seized at any customs port, a report must be filed with a written notification sent to the violator or his representative, as follows:
a) Articles 148/151/A - 168 of the Unified Customs Law impose a double fine on smuggled cigarettes and their derivatives, and direct the proceeds to the state treasury..
b) An amount equal to two times the estimated value of the smuggled food supplies should be imposed as a fine, and the food supplies should be confiscated according to Article 148 and 151/a of the Unified Customs Law.
c) A copy of the incident report shall be forwarded to the Legal Affairs Department within 72 hours of its issuance.
2. Normally, in the absence of the Director of the Authentication Department or the person he delegated, the Director General of the General Customs Administration would be authorized to impose the aforementioned fines on the person against whom the report was issued with the acceptance of reconciliation.
3. In the event that the affected party files a complaint about the incident, it should be submitted to the Legal Affairs Department for consideration and then to the Director General of GCA for further action.
4. The matter will be referred to the Legal Affairs Department if the fine imposed on the violator or his representative is not paid after 15 days according to the written notification from the date of service.
