Duo Acquitted In Kidnap, Rape Of Peddler
The Court of Appeals cancelled the decision of First Instance Court that sentenced two youths to 15 years imprisonment, and acquitted the duo of all charges leveled against them.
The Public Prosecution Department charged the suspects for kidnapping and raping an alcohol peddler and filming the incident, misusing mobile phone, attacking security operatives and causing damage to a patrol. In their defense, Attorney Jarrah Al-Anzi said the lawsuit is without material and moral basis, and insisted the alleged rape of the plaintiff never happened.
He pointed to lack of criminal intention and lack of substantial evidence and considered arrest and search procedures conducted on his clients illegal since it was done without warrant from the Public Prosecution. He stressed the whole scenario is illogical and malicious. He argued that his clients are rather the victims who suffered various degrees of injuries as indicated in the medical report, in addition to traces of bullets that went through the rear of their vehicle- another incident that was not included in the lawsuit.
No punishment: The Court of Cassation refrained from imposing punishment on two brothers – officers assigned in two different security sectors at the Ministry of Interior – who were accused of assaulting a citizen and deliberately damaging the latter’s car through collision, reports Al-Anba daily.
Case files indicate the citizen filed a complaint at Bayan Police Station but he was surprised when the officers assigned at the station purportedly tried to stop him from doing so, prompting him to approach other authorities in the ministry only to experience the same treatment. He then decided to resort to the judiciary.
