Drug Overdose Likely Cause As Prosecution Withholds Probe On Kuwaiti Citizen’s Death

Judicial sources disclosed that the Public Prosecution withheld investigation concerning late citizen Ahmad Al-Dhefari who passed away in detention at the General Drug Control Department of the Interior Ministry due to expiration of the criminal lawsuit on his death after receiving final report of the relevant fact-finding committee.

The same sources affirmed that report of the committee formed by the Deputy Prime Minister and Minister of Interior Anas Al-Saleh indicated the citizen died after taking an overdose of intoxicants, leading to heart failure.

The committee said the procedure of arrest and search conducted by an officer and security operatives affiliated to the Special Forces at Mubarak Al-Kabeer Governorate were legal and met Articles 43, 49, 52, 54 and 56 of the Procedures and Criminal Trials Law, denying rumors circulated that Al-Dhufairi was exposed to torture or beating.

Meanwhile, the family of late citizen Al-Dhufairi refused to take delivery of his corpse after they were informed about the report issued by the fact-finding committee on Thursday December 27, 2019. It said the citizen was detained in cell No .2 at 2:50 am on Wednesday December 18, 2019. He was later moved to another room at 3.36 am based on his own request where he stayed until he was declared dead on Wednesday, December 18 at 12.10 pm.

The committee said the cause of Al-Dhufairi’s death is mentioned in a report issued by the Forensic Department and report of the criminal laboratories at Ministry of Interior.

Meanwhile, according to the local Arabic daily Al-Rai the Public Prosecution has completed investigations into the death of Kuwaiti citizen Ahmad Al-Dhefairi while in custody of Drugs Control General Department (DCGD).

According to the investigations, the death was allegedly caused by an overdose of psychotropic substance, and the deceased was not subjected to any kind of physical torture. The Prosecutor came to this conclusion after interrogating a number of witnesses, the doctor’s treatment record of the deceased, the Forensic report, police investigations and after reviewing the footage of CCTV cameras installed at DCGD.

Investigations revealed that Al- Dhefairi was earlier charged with possessing psychotropic substances for the purpose of trafficking and abuse, and a final verdict had been issued against him. The Public Prosecution also concluded that the deceased had taken an overdose of a psychotropic substance before closing the file.
