Customs Fined Kd 59,000 In ‘eggs’ Lawsuit
In a final ruling, the Court of Appeals obligated the General Administration of Customs to pay compensation of KD 59,000 to a commercial company for not releasing a shipment of eggs that arrived from Brazil, causing it to get spoiled. According to the case file, the counsel representing the company Lawyer Muhammad Al-Jamie explained that the company imported eggs from Brazil at a value of KD 67,000. However, the shipment was denied entry by the customs department, which claimed that they are not suitable for human consumption. Eventually, the eggs got spoiled.
However, the customs department committed an error as the eggs were coming from Brazil to be exported to Iraq. The court affirmed that the evidence from the shipment documents showed that the eggs were destined to Iraq, and the shipment was in transit in Kuwait, due to which it should not have been subjected to the restrictions related to import or specifications, including laboratory test. Also, the sample test report carried out by the laboratories of the Ministry of Health in the State of Kuwait confirms its validity for human consumption.
