Court Ordered The Municipality To Pay Kd 364,000 Compensation To The Landlords Of An Old Building

The Court of Cassation has rejected an appeal filed by the director general of Kuwait Municipality against the ruling of the Court of Appeals which ordered the Municipality to pay KD 364,000 compensation to the landlords of an old building. Case files indicate that the landlords filed a lawsuit against the Municipality, its Expropriation for Public Welfare Department and Finance Ministry, through their lawyer Attorney Misfer Al-Ajmi demanding establishment of their ownership of a real estate property and compensation of its value. In his presentation, Al-Ajmi told the court that the father of the landlords bought the real estate in question in 1966. However, they were surprised when the Municipality issued a description of their real estate property which showed part of their father’s property is on State land and the other is on plots allocated to other people. Al-Ajmi pleaded to the court to establish the ownership of the real estate in question to the heirs and compensate them. The Court of Appeals then ordered the defendants to pay KD 364,000 to the plaintiffs.
