Court Of Appeals Upheld The Verdict Of The First Instance Court

Commercial Section at the Court of Appeals upheld the verdict of the First Instance Court, which refused to execute a foreign judgment ordering a company owned by a citizen to return its assets worth 3.8 million riyals to avoid litigation. Lawyer Dalal Al-Mutairi on behalf of heirs of the deceased citizen challenged the foreign judgment at the Court of Appeals and objected to the decision of the previous court quoting Article 201 of Kuwaiti civil law. She stressed the appellant company did not act within the permitted period as per Article 50; thus, the court acted rightly in rejecting the case.
