Court Grants Irrevocable Divorce To Kuwaiti Woman

The Hawally Family Court granted irrevocable divorce to a Kuwaiti woman due to irreconcilable differences with her exhusband, while her rights associated with marriage and divorce were withheld. According to the lawsuit filed by the plaintiff’s lawyer – Attorney Khawlah Al-Hassawi, the woman got married to the defendant under Islamic Law and the marriage was blessed with children. However, the woman did not enjoy the marriage because of incessant verbal and physical abuses through which their relationship became sour beyond redemption. The court tried its best to reconcile the couple, while meetings were arranged between witnesses from both families and the conclusion was that dissolution of marriage is the best option.

Property row: The Civil Court decided to issue a new property document stating that a residential building solely belongs to the ex-husband of a Kuwaiti woman who demanded 50 percent ownership of the building. The court dismissed the lawsuit filed by the woman who demanded for selling the building in a public auction and that half of the sale price should be given to her. Lawyer for the ex-husband, Attorney Mubarak Al-Khashab, requested the court to delete the name of the woman from the property document, pointing out that his client was forced to add the name of his ex-wife (before the divorce) to the property document in order to apply for a loan to buy a residential building. Al-Khashab presented documents proving that his client paid the loan in installments, including a certificate of the loan taken from Kuwait Credit Bank and another certificate showing that the purpose of the loan is to purchase a residential building.

Citizen acquitted: The Court of Appeals acquitted a citizen and overturned the five years jail term and KD 5,000 fine issued by the lower court. Case files indicate that the Public Prosecution charged the citizen with possession of narcotics (hashish and morphine) with the intention to consume and without providing evidence that he is allowed to consume such substances for medicinal purposes. The prosecution also charged him with driving under the influence of narcotics. However, his lawyer, Attorney Dalaal Al-Mutairi, argued that her client was arrested and searched illegally, given that the arresting officer failed to follow proper procedures. She said her client affirmed that the narcotics do not belong to him and even the car is not his, prompting the higher court to dismiss the case and acquit the citizen.
