Court Declared That ‘study, Work Can Go Side By Side’
The Court of Appeal has overturned by the verdict of a lower court which had deprived an employee of the right to education. The verdict, which some called historical, gives the state employees the right to education without taking permission of the employer, reports Al-Rai daily.
The judgment opens the door wide but the question is, is the judgment applicable only to the plaintiff or can everyone benefit from it? Assistant Undersecretary for Scholarships and Accreditations Affairs and Cultural Relations Department at the Ministry of Higher Education Fatma Al-Sanan said the ministry has yet to receive the copy of the judgment. The ministry can only give its opinion after reading a copy of the verdict.
Meanwhile, speaking to the daily, a reliable Civil Service Commission (CSC) source said it will look at the details of the judgment because permission to study and work at the same time can hamper the productivity of the employee.
The source expressed fear that some employees may take the advantage of this verdict and obtain forged documents and submit them to the concerned department to get time off, promotions and other benefits. The lawyer for the plaintiff, attorney Duwaim Al-Muwaizari said this verdict cover all the state employees which allows them to work and study at the same time and subsequently cancels the CSC decision which was issued in 2017 which did not give right to the state employees to study without the permission of their employers.
Meanwhile, attorney Niveen Ma’arafitold the daily the judgment will allow the employees to get more grades and help them reach senior positions. She pointed it is up to the government to knock the doors of the Court of Cassation.
