Contractor Acquitted Of Causing Death Of Worker Unintentionally

The Misdemeanor Court acquitted a contractor who was accused of unintentionally causing the death of a construction worker in a building under construction due to his negligence and failure to observe the safety conditions instructions.

Defending the contractor was Lawyer Jarrah Al-Enezi who explained that, “The distinguishing element of the crime of wrongful killing is the pillar of the error. If there is no error, there is no punishment and the act is considered accidental. If the act is accidental, it cannot be considered a crime.”

According to the rulings of the Court of Cassation in this regard, the injured is mistaken if he has failed to take necessary measures of endangering his life or lost foresight when working. “My client had fulfilled all aspects of security and safety, and the fate was inevitable”.
