Clinic Refusing To Give Nurse Local Release Even After Completing 3 Yrs

My wife is working in a private clinic. She joined the clinic on a local transfer. Now she has completed 3 years in same clinic and a total of 8 years in Kuwait. Now she submitted her resignation on Aug 25, 2016 due to better offer from others. But the clinic is refusing to give her a local release and has told her to wait until they get new candidates.

Can you suggest what she should do now and what are the further procedures. She wants to wait for 3 months to complete the notice period (up to Nov 25, 2016) or can she go to the shoun (Ministry of Social Affairs and Labor)?

Answer: The clinic can’t stop her from transferring to any other clinic because she joined them on a local transfer and as per the law she is required to stay with them for one year only after which she can seek a transfer. She has to only has to complete the 3-month notification period after which she should produce the transfer letter and if the company doesn’t sign it she can file a complaint with the Labor Office which will sanction the transfer.
