The Court of Appeals chaired by Judge Dherar Al- Waqyan upheld the verdict of the Court of First Instance and dismissed lawsuit a Kuwaiti businesswoman filed against a Canadian investor to appoint a judicial liquidator to shut down a general contracting company. The plaintiff sued her Canadian partner imploring the court to liquidate the general contracting company set up by the two of them. She also pleaded with the court to calculate her share of the company’s profits and capital. Defense Lawyer Ghanim Al-Sahli urged the court to consider the formal agreement through which the company was established, and prayed the court to dismiss the request for liquidation of the company since there’s no legal backing for that purpose. He noted his client has the right to complete the capital of investment, while the plaintiff has no right to a share of the capital or profits.
